1. INTRODUCTION
This Privacy Policy describes how Hidden Jam LLC ("Hidden Jam", "we", "us", "our") collects, uses, discloses and safeguards personal information in connection with our website, our booking and application process, and the travel experiences we organise ("Trips").

Hidden Jam markets and sells exclusively to clients contracting from the United States. We do not direct our services to, and do not knowingly accept bookings from, residents of the European Union, the European Economic Area or the United Kingdom. This Policy is accordingly framed by reference to United States law.
By using our website, submitting an application or making a booking, you acknowledge that you have read and understood this Policy.
2. Information You Provide

Medical conditions, disabilities, allergies, medications and pregnancy, where disclosed to us pursuant to our Terms and Conditions
Dietary requirements and preferences
Swimming ability and relevant experience levels for activities
We collect this information because it is necessary for your safety and for the proper performance of the Trip. You are not obliged to provide it, but we may be unable to accept your booking or permit your participation without it.
Payment information
Payment card details and bank transfer information are collected and processed directly by our payment providers. We do not store full payment card numbers on our systems. We retain transaction records, including amount, date, currency and the last four digits of the card where provided to us.
2.2 Recordings of Introductory Calls
We record introductory and selection calls, including audio and, where the call is conducted by video, video.
Recordings are used to assess applications, to maintain a record of what was discussed and agreed, and for internal training and quality purposes.
We will notify you at the beginning of any call that it is being recorded and will seek your consent to the recording. Where you do not consent, we will conduct the call without recording; this does not affect the assessment of your application. You may request deletion of a recording at any time in accordance with Clause 7.

Publicly available information, including social media profiles, where reviewed as part of the application process

Referral information, where you are introduced by an existing client or through our referral programme
2.5 Information About Other Persons
Where you provide information about another person, including a fellow traveller or emergency contact, you warrant that you are authorised to do so and that you have informed them of this Policy.
3. HOW WE USE INFORMATION
We use personal information for the following purposes:
Assessing applications and selecting participants, including reviewing applications, conducting and recording introductory calls, and determining whether to offer a place.
Performing the contract, including processing bookings and payments, confirming reservations, communicating regarding your Trip, and arranging your participation.
Arranging services with Suppliers, including transmitting information necessary for charter companies, accommodation providers, restaurants, activity operators and transport providers to deliver the services comprised in your Trip.
Health, safety and emergency response, including communicating dietary requirements and allergies to caterers and hosts, informing skippers and guides of conditions relevant to safety, and contacting your emergency contact or insurer and arranging medical assistance in an emergency.
Insurance verification, including confirming that you hold cover meeting our requirements.
Marketing. Where you make a booking or submit an application, we add your email address to our mailing list and send information about future Trips and related content. You may unsubscribe at any time using the link in any marketing email or by contacting us. Unsubscribing does not affect operational messages concerning a booking you have made.
Photography, video and promotional content. We and our representatives photograph and record Trips, and we use images and recordings in which participants appear for marketing and promotional purposes, including on our website, social media, in advertising and in editorial material. This is addressed further at Clause 4.
Improving our services, including analysing website usage, understanding which Trips and content are of interest, and developing our offering.
Legal and administrative purposes, including accounting and tax records, responding to legal claims, resolving payment disputes, complying with sanctions and anti-money-laundering obligations, and enforcing our Terms and Conditions.
4. PHOTOGRAPHY, VIDEO AND PROMOTIONAL USE
By participating in a Trip you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce and distribute images and recordings in which you appear for marketing and editorial purposes across all media, as set out in our Terms and Conditions.
You may opt out by written notice to ==[PRIVACY EMAIL]== prior to departure. Opting out does not extend to group images in which you appear incidentally and are not the subject.
Where you have opted out, we will not use identifiable images of you in new promotional material. We are not able to withdraw material already published, distributed or reshared by third parties, and we do not control content posted by fellow participants.
Fellow participants may photograph and record during Trips. Our Terms and Conditions require them to obtain consent before doing so, but we do not control and are not responsible for content created or shared by other participants.
5. DISCLOSURE OF INFORMATION
We do not sell personal information.
We disclose personal information to the following categories of recipient:
5.1 Suppliers Delivering Your Trip
Charter companies, vessel owners and skippers; hotels, châteaux, villas and other accommodation providers; restaurants and caterers; activity operators, instructors and guides; and ground transport providers.
We disclose only what is necessary for the relevant service, which typically comprises name, and where relevant passport details for charter and accommodation registration, dietary requirements and allergies, emergency contact details, and insurance details.

6. RETENTION
We retain personal information for the following periods:

Where information is required in connection with an actual or anticipated legal claim, we retain it until the matter is resolved.
7. YOUR CHOICES AND RIGHTS
We extend the following rights to all our clients, irrespective of the state in which you reside:
Access. You may request confirmation of whether we hold personal information about you and a copy of it.
Correction. You may request correction of inaccurate or incomplete information.
Deletion. You may request deletion of your personal information. We may retain information where we are required to do so by law, where it is necessary for tax or accounting purposes, or where it is required in connection with an actual or anticipated legal claim.
Marketing opt-out. You may unsubscribe from marketing communications at any time using the link in any marketing email or by contacting us.
Call recording deletion. You may request deletion of any recording of an introductory call.
Photography opt-out. You may opt out of promotional use of your image as described at Clause 4.
Copies of information. You may request a copy of the information you have provided to us in a portable format.
To exercise any of these rights, contact cami@hiddenjam.co. We will respond within 45 days. We may need to verify your identity before acting on a request, and will not require more information than is necessary to do so.
We will not discriminate against you for exercising any of these rights, including by denying services, charging different prices or providing a different quality of service.
7.1 California Residents
Where you are a resident of California, you may have additional rights under the California Consumer Privacy Act as amended. We do not sell personal information and do not share personal information for cross-context behavioural advertising as those terms are defined under that Act, save to the extent that the use of advertising and analytics technologies described at Clauses 5.2 and 8 may constitute sharing thereunder. You may opt out of such technologies through our cookie controls.
You may designate an authorised agent to make a request on your behalf, subject to verification.
8. COOKIES AND TRACKING TECHNOLOGIES
We use cookies and similar technologies for the following purposes:
Strictly necessary — enabling website functionality, security and load balancing. These cannot be disabled.
Analytics — understanding how visitors use our website, which pages are viewed and how our website performs.
Advertising and measurement — measuring the effectiveness of our advertising and delivering relevant advertising, including through Meta advertising and pixel technology. These technologies allow the relevant provider to associate your visit to our website with your account on their platform.
You may manage cookies through our cookie banner or through your browser settings. Disabling cookies may affect website functionality.
Do Not Track. Our website does not currently respond to Do Not Track browser signals. We do honour opt-out preference signals where required by applicable state law.
9. SECURITY
We implement administrative, technical and physical safeguards designed to protect personal information, including access controls, encryption in transit, and restricting access to those who require it.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any credentials used to access our services.
Where a security incident affecting your personal information occurs, we will notify you and any applicable authority where required by law.
10. INTERNATIONAL TRANSFERS
We are established in the United States and process information there. Because our Trips take place internationally, information necessary to deliver your Trip is transmitted to Suppliers located outside the United States, including charter companies, accommodation providers and activity operators in the countries in which Trips take place.
By making a booking you acknowledge that your information will be transferred to and processed in those countries, which may have data protection standards different from those of the United States.
11. CHILDREN
Our services are directed exclusively to adults. We do not accept bookings from or on behalf of persons under 18 and do not knowingly collect information from children. Where we become aware that we have collected information from a person under 18, we will delete it.
12. CHANGES TO THIS POLICY
We may update this Policy from time to time. The current version is published on our website with the effective date shown above. Where changes are material, we will notify you by email or by notice on our website. Your continued use of our services following such notice constitutes acceptance of the updated Policy.
